Supreme Courts (Highest Instance)

The Supreme Court is the highest jurisdiction of the Kingdom of Morrocco and its competence covers the whole country. It was created by law 223-57 of 27 September, 1957. The Supreme Court consists of six chambers : -The civil chamber -The family matters chamber -The commercial chamber -The administrative chamber -The social chamber -The criminal chamber

First Instance Courts

The First instance courts are organized by Law No 1-74-338 of July 15, 1974 First instance courts have competence to pronounce judgment in all matters, except when the law gives expressly competence to another jurisdiction. In civil matters, courts of first instance pronounce final judgment when the amount of litigation is equal or lower than 3,000 DHs. If the value of litigation is higher than this amount, the court rules only primarily and appeal can be entered against its decision. In penal matters, they are competent to judge fines and offenses, but all criminal matters fall under the competence of the court of appeals. The Sadad courts are courts of first instance for Muslim and Jewish personal law.

Administrative Courts (First Instance)

The administrative courts are organized by Law 41-90 and dahir n° 1-91-225 (22 rabia I 1414) of 10 septembre 1993 . There are 7 administrative courts in the main provinces of the Kingdom.

The administrative courts are competent to judge in first instance:

· petition for remedy for ulta vires filed against the decisions of administrative authorities;
· litigations relating to administrative contracts;
· actions for compensation for damages caused by the acts or activities of public persons;
· litigations arousing from the application of the legislation and regulations relating to pensions and death insurance of civil servants, and employees of the local collectivities, public establishments and the administrative staff of the House of Representatives;
· tax litigation;
· expropriations;
· electoral litigations;
· control of administrative acts legality.

Other Courts

The courts of commerce were created under the law No 53-95 of January 6, 1997, promulgated by the Edict No 1-97-65 of February 12, 1997. Jurisdictions of commerce have competence to rule on all commerce related litigations.

The courts of commerce are competent to rule on:

· actions relating to commercial contracts;
· actions between tradesmen resulting from their commercial activities;
· actions relating to bills of exchange;
· disputes between associates of a commercial company;
· disputes relating to commercial establishments.

The courts of commerce have competence to statue on cases that the value exceed twenty thousand dirhams (20.000 DHs +/- US $ 1800).
