Federal Supreme Court (Highest Instance)

The Federal Court is the Highest Instance and trials on appeals from the Court of Appeal, unless the appeal is not originating from the High Court as first instance. A leave from the Federal Court is required. The Federal Court consists of a president (Chief Justice), the President of the Court of Appeal, the two Chief Judges of the High Courts and four Federal Court judges

The Court of Appeal trials on civil and criminal appeals against decisions of the High Courts, unless it involves claims less than 250000 rm. A leave for Appeal must be obtained from the Appeal Court. The Court consitst of 8 Court of Appeal Judges and the President of the Court of Appeal.

Regional courts

The High Courts hear appeals from the Lower Courts in civil and criminal matters and have general jurisdiction (claims that exceeds 250,000 Malaysian ringgit) , except for criminal matters involving Islamic law. Trials are lead by a single judge or by a judicial commissioner.

First Instance Courts

The Magistrates' Courts and Sessions Courts in Malaysia decide on civil and criminal matters in first instance. Penghulu's Courts have civil jurisdiction till 50 RM and a criminal jurisdiction to minor offences
Magistrates Courts have civil jurisdiction till 25000 RM and a criminal jurisidiction for sentences not exceeding 10 years. The court is also appellate court for Penghulu's Courts.
Sessions Courts have civil jurisdiction till 250000 RM and a general criminal jurisidiction except for cases punishable with the sentence of death.
