Federal Supreme Court (Highest Instance)

The Federal Supreme Court is the highest instance in Argentina and has jurisdiction on all provices and the Federal capital. The Court consists of 9 judges, appointed by the president with approval of the Senate. The Supreme Court has the power to declare legislative acts unconstitutional. Ssection 116 of the National Constitution establishes that The Supreme Court and the lower courts of the Nation are empowered to hear and decide all cases arising under the Constitution and the laws of the Nation, except for matters under provincial jurisdictions. In such cases, according to section 117, the Supreme Court shall have appellate jurisdiction. Exclusive jurisdiction is given to the Court on cases concerning public executives , matters in which the Nation shall be a party and matters arising where two or more provinces are involved.

The 'Camara Nacional de Apelaciones' acts as the Court of Appeal for the lower courts on the federal level. There are nine appellate courts at federal level, consisting of three judges each.

Next to the Federal Court hierarchy, A Provincial court hierarchy exists in Argentina. Depending on the cases and people involved, a case will be trialed by a Federal Court or a Provincial Court.
The Highest Judicial Instance in a province is the Tribunal Superior de Justice. There is a Tribunal Superior in each of the 23 provinces and in the Federal capital. As the provinces are autonomous, The Superior Court is the last Judicial instance in the Province. Only in exceptional matters the Federal Supreme Court will act as the ultimate judicial instance. However the court has the supervision to control legality of the judicial processes in the provinces.
